These Terms of Service (“Terms”) govern your access to and use of AgenticSEO by Traction Gap Partners (the “Service”), operated by Traction Gap Partners, LLC (“TGP”, “we”, “us”). By creating an account or using the Service you agree to these Terms.
1. The Service
The Service provides search and AI-visibility tooling, including:
- AgenticSEO — site audits that produce classical SEO metadata, Agentic/AI metadata layers, JSON-LD, a site-wide
llms.txtfile, and a branded .docx report. - AI Visibility — prompt-based tracking of how your brand and content appear in answers from large language models, including citation and gap analysis.
- Finn AI — an in-product assistant that helps you interpret reports and recommendations.
2. Accounts
You must provide accurate information at signup, including your name, email, company, and website (unless you indicate you are an agency). You are responsible for activity under your account and for keeping your credentials secure. You must be at least 16 years old to use the Service.
3. Plans, Payment, and Refunds
- Subscription plans are billed monthly via Stripe and renew automatically until cancelled. You may cancel at any time from the Manage screen; access continues through the end of the paid period.
- One-time reports are sold for $29 USD per report and are non-refundable once the full report has been generated. A free 5-page preview is available before purchase so you can evaluate the output.
- Refunds outside the preview are issued only at TGP’s discretion (e.g., duplicate charges or failed delivery) and are processed via Stripe.
- Plan changes (upgrade, downgrade, pause, resume) take effect as described in the Manage screen at the time of the change.
4. Acceptable Use
You agree not to:
- Submit URLs or content you do not have the right to analyze or publish.
- Use the Service to generate spam, deceptive content, or content that violates third-party rights.
- Reverse engineer, resell, or attempt to circumvent rate limits or access controls.
- Upload malware or interfere with the Service’s operation or other users.
5. Service Limits and Fair Use
Each plan includes a monthly page allowance and a per-run cap. Allowances reset on the first day of each calendar month (UTC). Current published limits are:
- Free preview: 5 pages per run, evaluation only.
- One-time report ($29): a single audit of up to 500 pages.
- Starter ($39/mo): up to 1,300 pages per month, 500 pages per run.
- Pro ($99/mo): up to 3,300 pages per month, 1,500 pages per run.
- Agency ($199/mo, includes 5 clients): up to 6,600 pages per month plus 700 pages per additional client. Each client beyond the included 5 adds $20/month to the base price. 2,500 pages per run.
- Enterprise: custom monthly volume, per-run cap, and SLA, set in your order form.
Runs that would exceed the monthly allowance for a plan are paused and the client is invited to upgrade or to discuss an Enterprise plan. TGP may additionally throttle, queue, or pause runs that exceed published rate limits, that present an unusual cost profile, or that we reasonably suspect of abuse. Sustained usage materially above the published allowance for a plan requires an Enterprise agreement.
6. Your Content and License
You retain ownership of the URLs and copy you submit (“Your Content”). You grant TGP a limited, worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to operate and improve the Service for you. We do not use Your Content to train third-party foundation models.
Each full report requires you to accept the then-current versioned License Acceptance shown in-product, which governs use of the generated metadata, llms.txt, and JSON-LD output.
7. AI Providers
The Service uses the following AI providers, accessed via the Lovable AI Gateway and direct APIs:
- OpenAI (GPT-5 family) — metadata generation, AI Visibility prompt runs.
- Google Gemini (2.5 / 3.x family) — metadata generation, AI Visibility prompt runs, image-aware analysis.
- Finn AI — in-product assistant powered by the above providers.
AI output is generated probabilistically and may contain inaccuracies. You are responsible for reviewing output before publishing it.
8. Third-Party Services
The Service integrates with third-party platforms you choose to connect, including Stripe for payments. Your use of those platforms is governed by their own terms.
9. Intellectual Property
The Service, including its software, branding, and report templates, is owned by TGP and protected by intellectual property laws. Except for Your Content and the license above, no rights are transferred to you.
10. Confidentiality
Each party agrees to protect the other’s non-public information disclosed in connection with the Service using at least the same care it uses to protect its own.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TGP DOES NOT WARRANT ANY SPECIFIC SEARCH-ENGINE OR LLM RANKING, TRAFFIC, OR REVENUE OUTCOME.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TGP’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TGP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100. TGP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA.
13. Indemnification
You will defend and indemnify TGP from claims arising from Your Content or your violation of these Terms or applicable law.
14. Termination
You may stop using the Service and delete your account at any time from the Manage screen. We may suspend or terminate access for violation of these Terms or for risk to the Service or other users. Sections that by their nature should survive (IP, disclaimers, liability, indemnification, governing law) survive termination.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Deschutes County, Oregon, and the parties consent to personal jurisdiction there.
16. Changes
We may update these Terms by posting a revised version with a new effective date. Material changes will be communicated by email or in-product notice. Continued use after the effective date constitutes acceptance.
